1. About These Terms

These Terms of Service (“Terms”) govern your use of the SnagMail mobile application and website (together, the “Service”), operated by MAKAN App Ltd, a company registered in England and Wales.

By using SnagMail, you agree to these Terms. If you do not agree, please do not use the Service.

2. The Service

SnagMail is a property inspection and snagging report tool for iOS. It allows you to create, store, and share property inspection reports including photos, annotations, and notes.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes where practicable.

3. Accounts

You may need to create an account to use certain features. You are responsible for maintaining the security of your account credentials and for all activity under your account.

You must provide accurate information and be at least 16 years old to use the Service.

4. Free Tier and Subscriptions

SnagMail offers a free tier that includes one inspection report. For unlimited reports and additional features, you can subscribe to SnagMail Pro.

  • Pricing: SnagMail Pro is currently £4.99/month. Prices may change with reasonable notice.
  • Billing: subscriptions are billed through Apple's App Store. Apple's terms and payment policies apply to all purchases.
  • Renewal: subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.
  • Cancellation: you can cancel your subscription at any time through your Apple ID settings. You will retain access to Pro features until the end of your paid period.
  • Refunds: refund requests are handled by Apple in accordance with their refund policy.

5. Your Content

You retain full ownership of all content you create using SnagMail, including inspection reports, photos, and notes (“Your Content”).

By using the Service, you grant us a limited licence to store, process, and transmit Your Content solely for the purpose of providing the Service to you. We will not use Your Content for any other purpose.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to reverse-engineer, decompile, or disassemble the app.
  • Upload content that is defamatory, obscene, or infringes on third-party rights.
  • Interfere with or disrupt the Service or its infrastructure.
  • Share your account credentials with others or allow unauthorised access.

We may suspend or terminate accounts that violate these terms.

7. Intellectual Property

The SnagMail app, website, branding, and all associated intellectual property are owned by MAKAN App Ltd. Nothing in these Terms grants you any rights to our intellectual property beyond the right to use the Service as intended.

8. Disclaimers

SnagMail is a tool to help you create property inspection reports. It does not constitute legal, surveying, or professional advice.

While we strive for accuracy and reliability, the Service is provided “as is” and “as available” without warranties of any kind, to the extent permitted by law. We do not guarantee that reports generated by SnagMail will meet the specific requirements of any deposit scheme, court, or regulatory body.

9. Limitation of Liability

To the maximum extent permitted by applicable law, MAKAN App Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

10. Termination

You may stop using the Service at any time by deleting your account and uninstalling the app. We may terminate or suspend your access if you breach these Terms, with notice where reasonably practicable.

Upon termination, your right to use the Service ceases. We will delete your personal data in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or an in-app notification at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you retain any mandatory consumer protection rights granted by the law of your country of residence.
